Update: Domstolen refererar till punkt 103 i domen MARPER v. UK, som jag skrev om här och här.
Den tyska arbetsgruppen mot datalagringsdirektivet (AKVDS) skriver i ett pressmeddelande att en domstol i Wiesbaden har förklarat att datalagringsdirektivet är ogiltigt (ungültig):
"The court is of the opinion that data retention violates the fundamental right to privacy. It is not necessary in a democratic society. The individual does not provoke the interference but can be intimidated by the risks of abuse and the feeling of being under surveillance [...] The directive [on data retention] does not respect the principle of proportionality guaranteed in Article 8 ECHR, which is why it is invalid."
Nu gäller det! Alla aktivister i Sverige måste nu hjälpas åt att fördröja den svenska implementationen. Det räcker inte med att blogga, nu måste vi in i riksdagens korridorer och in på utskottens möten och visa vägen ut ur det här mörkret. Börja med att insistera på att några riksdagsledamöter åker på studieresa till Norge (som inte vill ha direktivet och som behöver Sverige för att slippa), Polen (där alla sex polisväsen vill ha), Danmark (som inte vet vad det kostar) och Portugal (som inte vet vad det handlar om). När ni kommit tillbaka ska vi ha paneldebatter om era observationer, om den tyska domen och ställa frågan igen ÄR DET VERKLIGEN NÖDVÄNDIGT?.
Sen ska vi sätta oss ner och skriva ett nytt bättre implementationsförslag, och skicka ut det på remiss, osv osv. Då MÅSTE kommissionen stämma oss. OCH DÅ VINNER VI!
